In State v. Moeller, 105 Or App 434, 806 P2d 130, rev dismissed, 312 Or 76, 815 P2d 701 (1991), the Court of Appeals held that the words "scheme or network" in OAR 253-04-002, App 4, are unconstitutionally vague, in violation of Article I, sections 20 and 21, of the Oregon Constitution. The correctness of that holding is not before us here. The effect of that holding was to affirm the trial courts order setting aside the indictment in that case.
